Terms of Service - Onirico

Welcome to Onirico! These Terms of Service (“Terms”) govern your use of our mobile application (the “App”). By using our App, you agree to these Terms.

1. Your Relationship with Us

By creating an account or using the App, you are entering into a binding agreement with Onirico. Your use of the App is also governed by our Privacy Policy, which is incorporated here by reference.

2. User Accounts and Access Tiers

The App offers different levels of access:

• **Guest Users:** Users who have not created an account have limited access to the App's features.

• **Registered Users:** Users who create a free account gain access to a wider range of features.

• **Premium Users:** Users may upgrade their access through a one-time purchase or an auto-renewable subscription to unlock premium features and/or remove advertising.

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to provide accurate and up-to-date information.

3. Permitted Use

The App is for your personal, non-commercial use only. You agree not to use the App for any illegal or unauthorized purpose.

4. Your Content and License Grant

You retain full ownership of the content you create in the App (“Your Content”), such as your dream journal entries.

By using the App, you grant Onirico a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, and display Your Content in connection with operating, developing, and improving the App and our services. This includes the right for us to use your dream entries in an anonymized and aggregated form for analytics and service improvement, as detailed in our Privacy Policy. This license does not grant us the right to sell your personally identifiable data.

5. In-App Purchases and Subscriptions

Our App is supported by advertising and offers optional in-app purchases and subscriptions.

• **Advertisements:** Unless you purchase an ad-free option, you agree that the App may display advertisements from third parties, such as Google AdMob.

• **One-Time Purchases:** You may purchase non-consumable products, such as a lifetime "Premium" or "Ad-Free" option. This purchase is tied to your App Store account and can be restored on any device associated with that account.

• **Auto-Renewable Subscriptions:** We offer "Onirico Premium" subscriptions on a monthly or annual basis.

• **Payment and Renewal:** Payment will be charged to your Apple ID account at the confirmation of purchase. The subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

• **Managing Subscriptions:** You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.

• **Free Trials:** Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

6. API Usage Limits

To ensure service stability and fair use, we apply rate limits to certain features (e.g., dictionary searches). These limits may vary based on your user status (Guest, Registered, or Premium). We reserve the right to change these limits at any time. Attempting to circumvent these limits is a violation of these Terms.

7. Our Intellectual Property

The App and its original content (excluding Your Content), features, and functionality are and will remain the exclusive property of Onirico. We grant you a limited, non-exclusive, non-transferable license to use the App for your personal use according to these Terms.

8. Termination

You can terminate this agreement at any time by deleting your account from within the App. We may suspend or terminate your access to the App if you breach these Terms, without prior notice or liability.

9. Disclaimer of Warranties

The App is provided “AS IS” and “AS AVAILABLE,” without any warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the fullest extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Brazil. You agree to submit to the exclusive jurisdiction of the courts located in Rio de Janeiro to resolve any legal matter arising from the Terms.
