Terms of Service - Onirico

Welcome to Onirico! These Terms of Service (“Terms”) govern your use of our mobile application (the “App”). By using our App, you agree to these Terms.

1. Your Relationship with Us

By creating an account or using the App, you are entering into a binding agreement with Onirico. Your use of the App is also governed by our Privacy Policy, which is incorporated here by reference.

2. User Accounts and Access Tiers

The App offers different levels of access:

• **Guest Users:** Users who have not created an account have limited access to the App's features. Functionality and API usage are restricted as described in Section 5.

• **Registered Users:** Users who create a free account gain access to a wider range of features.

• **Supporter Status:** Registered users may make a one-time purchase to remove advertising from the App.

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to provide accurate and up-to-date information.

3. Permitted Use

The App is for your personal, non-commercial use only. You agree not to use the App for any illegal or unauthorized purpose.

4. Your Content and License Grant

You retain full ownership of the content you create in the App (“Your Content”), such as your dream journal entries.

By using the App, you grant Onirico a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, and display Your Content in connection with operating, developing, and improving the App and our services. This includes the right for us to use your dream entries in an anonymized and aggregated form for analytics and service improvement, as detailed in our Privacy Policy. This license does not grant us the right to sell your personally identifiable data.

5. Advertisements, In-App Purchases, and API Usage Limits

Our App is supported by advertising and in-app purchases.

• **Advertisements:** Unless you purchase the ad-free option, you agree that the App may display advertisements from third parties, such as Google AdMob.

• **Ad-Free Option (Supporter Status):** You may purchase a one-time, non-refundable "Ad-Free" option. This purchase is tied to your Onirico account and removes third-party banner and interstitial ads from the App. We will verify your purchase with the respective app store (Google Play Store or Apple App Store) to grant this entitlement.

• **API Usage Limits:** To ensure service stability and fair use, we apply rate limits to certain features (e.g., dictionary searches). These limits vary based on your user status (Guest or Registered). We reserve the right to change these limits at any time. Attempting to circumvent these limits is a violation of these Terms.

6. Our Intellectual Property

The App and its original content (excluding Your Content), features, and functionality are and will remain the exclusive property of Onirico. We grant you a limited, non-exclusive, non-transferable license to use the App for your personal use according to these Terms.

7. Termination

You can terminate this agreement at any time by deleting your account from within the App. We may suspend or terminate your access to the App if you breach these Terms, without prior notice or liability.

8. Disclaimer of Warranties

The App is provided “AS IS” and “AS AVAILABLE,” without any warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Brazil. You agree to submit to the exclusive jurisdiction of the courts located in Rio de Janeiro to resolve any legal matter arising from the Terms.
